Deadlines: Let your landlord know as soon as possible if you intend to cancel your long term lease.

Description: If your rental unit is so damaged it is unfit to live in you have the right to leave the property and stop paying rent. If the cost of repairing the property is more than a year’s rent and you are up-to-date with your rental payments, you can usually cancel your lease. If an apartment is under rent control, the tenant usually has a right to return following a disaster.

Notes: If the property is completely destroyed and the lease is terminated, the obligation to pay future rent due is extinguished.  However, rent paid in advance cannot be recovered by the tenant unless the lease provided for a rent apportionment.
